Aktivist*innen der Geflüchteten-Selbstorganisation aus Baden-Württemberg haben eine Sammelabschiebung in Nigeria beobachtet. Eine nigerianische Zeitung berichtet über die Ankunft der Abgeschobenen, die im Flugzeug gefesselt waren und nach der Landung ohne jegliche Unterstützung „abgeladen“ wurden. Der im Artikel zitierte Mann namens „Mike“ war zuvor mehrere Monate in der Abschiebehaft in Pforzheim. Er ist Krebspatient, und ein vorheriger Abschiebungsversuch mit einem Linienflug scheiterte, weil der Pilot sich weigerte, den offensichtlich schwer Kranken mitzunehmen. Bei einem Charterflug hat man solche Probleme natürlich nicht.

Statement by German refugee helpers on deportations to The Gambia
German refugee helpers have written a Statement of concern to the Gambian leader, HE Adama Barrow, and copied to the Executive and Legislative arms of the Gambian Government. The said Statement of Concern was copied to ministers and the Speaker of the National Assembly.
The collective and individual deportations of the previous months from Germany to The Gambia were perceived both in The Gambia and in Germany with great dismay. Arrests out of German companies, the handcuffing of deportees and detention in deportation prisons have led to criticism of deportation practices in both countries.
The „Flüchtlingsrat Baden-Württemberg e.V.“ and the information platform „Gambia-Helfernetz“ have now sent a statement of concern to the President of the Republic of The Gambia, His Excellency Mr. Adama Barrow. Both are organisations of supporters of refugees in Germany who stand up for the rights of refugees in Germany and support their integration into German society and the German working world. The members and participants of both organizations are mainly from the state of Baden-Württemberg in southwest Germany. A large part of the Gambian migrants is living in this Federal State, and almost all Gambians who have been deported from Germany in recent months have previously lived in this Federal State.
The statement was handed over to the President, the Vice-President, the members of the Government and the Speaker of the National Assembly on 25/26 July in the name of the above-mentioned German organisations. The German bearers of the memorandum regret that it was unfortunately not possible to present the memorandum personally at The Gambia. They hope that their statement nevertheless will be heard and would look forward to feedback from the President, the Vice-President and other members of the Government of the Republic of The Gambia.

VG München: Rückschiebung aufgrund von „Seehofer-Deal“ rechtswidrig
Das Verwaltungsgericht München hat in einem Eilverfahren angeordnet: Ein Afghane, der nach dem deutsch-griechischen Verwaltungsabkommen — dem sogenannten „Seehofer-Deal“ — von der deutsch-österreichischen Grenze direkt nach Griechenland abgeschoben wurde, ist umgehend zurückzuholen. Der afghanische Schutzsuchende wurde im Mai nach Übertritt der deutsch-österreichischen Grenze von der Bundespolizei im Zug aufgegriffen. Ohne jegliche Einschaltung des Bundesamtes für Migration und Flüchtlinge (BAMF) entschied die Bundespolizei allein auf Grundlage eines sog. EURODAC-1-Treffers, d.h. einer Registrierung und Antragstellung in Griechenland, diese Person nach Griechenland zu verbringen. Das VG München hat in dem Beschluss vom 08.08.2019 (Az. M 18 E 19.32238) erhebliche Zweifel an der Vorgehensweise der Bundespolizei geäußert: Es sei keine europarechtliche Grundlage ersichtlich, die diese Maßnahme rechtfertige. Auch sei die Bundespolizei nicht die zuständige Behörde – sondern eben das BAMF, das für die Prüfung von Asylanträgen und dem damit zusammenhängenden sog. Dublin-Verfahren zuständig ist.

Ein Plan für Gambia
Gerald Knaus von der Europäischen Stabilitätsinitiative fordert in der Debatte um Abschiebungen nach Gambia eine neue Sichtweise, die Realitäten auf beiden Seiten anerkennt. Gambia sei bei der Rücknahme seiner Staatsangehörigen kooperativer als jedes andere afrikanisches Land. Forderungen, noch mehr Abschiebungen durchzuführen, beurteilt er als unrealistisch und als Gefährdung der jungen Demokratie in Gambia.
